Terms of Service

Welcome to Tutram. These terms describe the deal between you and us when you use our platform. We've tried to write them in plain English instead of legal jargon. By creating an account, you agree to follow these rules; if you don't agree, please don't use Tutram.

For privacy and data handling, see our Privacy Policy — these terms work together with that one.

1. What Tutram is

Tutram is a software platform that lets sellers — small businesses, creators, individual entrepreneurs — set up and run their own branded online shop. We give you the tools: a storefront page, product management, order intake, basic analytics, integrations with messaging apps and Instagram, and AI helpers that speed up content writing.

We are not a marketplace. We don't list your products on a Tutram-branded catalog, we don't take a cut of your sales, and we don't decide what you sell — your shop is your shop, on your URL, with your branding. We're the rails; you drive the train.

2. Your account

To use Tutram you need an account. When you sign up:

• Use accurate information — your real name and a working email. Buyers see some of this on your shop page, and we need to reach you about your account.
• Keep your password safe. You're responsible for activity that happens through your login. If you suspect someone else has accessed your account, change your password immediately and email us.
• One person or business per account. Don't share logins.
• You must be at least 16 years old to use Tutram. If you're running a registered business, you must be authorized to enter into agreements on its behalf.

3. What you can and can't sell

Tutram is a general-purpose commerce platform, but a few categories are off-limits — both because of the law and because hosting them would put every other seller on the platform at risk:

• Anything illegal in your jurisdiction or ours.
• Counterfeit goods, stolen goods, or pirated digital content.
• Weapons, ammunition, explosives, or items intended to evade lawful security measures.
• Drugs, controlled substances, prescription medications, or paraphernalia.
• Adult content, sexually explicit material, or escort services.
• Content that promotes hate, violence, harassment, or discrimination against any group.
• Misleading health claims, financial scams, MLM/pyramid schemes, or anything designed to deceive buyers.
• Items that infringe someone else's intellectual property.

If we find a shop selling any of the above, we'll suspend it. Repeat or serious violations result in permanent removal.

4. Your content

You keep ownership of everything you upload — product photos, descriptions, your brand name, your logo. By uploading it to Tutram you give us permission to host it, display it on your public shop page to buyers, include it in our backups, and process it through the AI features you choose to use. Nothing more.

You're responsible for making sure you have the right to use every image, text, and trademark you upload. Don't post other people's photos as your own product photos.

5. Subscriptions & payments

Tutram has a free tier with basic features and paid plans that unlock more (higher product limits, Instagram import, advanced analytics, custom domain, etc.). Plan details and prices are on the pricing page; we may change them, and when we do we'll give existing paying sellers reasonable notice before the change takes effect.

• Subscriptions are billed in advance, per month or per longer term, depending on what you pick.
• You can cancel from your account at any time. After cancel, paid features stay active until the end of the period you've already paid for; we don't issue partial refunds for unused days unless you have a specific reason and we choose to make an exception.
• If a payment fails, we'll try to charge again and notify you. If we can't collect, we may downgrade your shop to the free tier (your shop and data stay; some features switch off).

6. No guarantee of sales

7. Acceptable use

Don't:

• Spam your buyers or other Tutram users.
• Try to break, probe, or reverse-engineer the platform.
• Run automated scrapers against our public pages or APIs beyond the documented rate limits.
• Impersonate another seller, brand, or Tutram itself.
• Use Tutram to launder money, evade taxes, or facilitate any other unlawful activity.

8. Suspension & termination

We can suspend or close an account that breaks these terms, especially the rules in Sections 3 and 7. We aim to give a warning first when the issue is borderline, but for serious violations (illegal content, fraud, security threats) we may act immediately and explain afterwards.

You can close your account at any time from your dashboard. When you do, we follow the data-retention rules in our Privacy Policy: a short grace period in case you change your mind, then permanent removal.

9. AI features

Tutram includes AI helpers — for product descriptions, drafting messages, polishing text, and parsing Instagram captions into product drafts. AI output is suggestion-quality, not authoritative; always review it before you publish. We don't guarantee the AI will produce the wording you want, won't make mistakes, or won't miss details. Treat it as a fast first draft you edit, never as something that ships untouched.

10. Third-party integrations

When you connect external services to Tutram (Instagram, Telegram, Google login, etc.), you're agreeing to those services' own terms too. Tutram doesn't control how those services behave, and we can't promise they'll always be available or work the way they do today. If a third-party service changes or shuts down, the related Tutram feature may stop working — we'll do our best to adapt, but we can't fix every breakage.

11. Limitation of liability

Tutram is provided "as is." We work hard to keep the platform running smoothly, but we can't guarantee zero downtime, zero bugs, or zero data loss — software never can. To the maximum extent permitted by law:

• We aren't liable for lost profits, lost sales, or lost customers caused by an outage, a bug, or a third-party integration changing.
• Our total liability for any claim, in any 12-month period, is capped at the amount you paid us for Tutram in that same period (or 100 USD if you haven't paid us anything).
• Nothing in these terms tries to limit liability that the law doesn't allow us to limit (e.g. for gross negligence or willful misconduct).

12. Changes to these terms

We may update these terms over time as the platform evolves or as the law requires. When the change is material, we'll notify you in-app or by email and update the "Last updated" date at the top of this page. If you keep using Tutram after a change takes effect, you're agreeing to the new version. If you don't, you can close your account at any time.
